§ 1 Scope of Application

The business relationship between regiospectra Verlag (owner Eva Streifeneder, “Publisher”) and the “Customer” are governed exclusively by the following general terms and conditions in the version applicable at the time an order is placed. Any deviating terms and conditions on the part of the Customer will not be recognized by the Publisher unless the Publisher has explicitly agreed to their validity.

 

§ 2 Conclusion of Contract

When placing an order, a sales contract is concluded with: regiospectra Verlag, owner Eva Streifeneder, Kolonnenstraße 8, 10827 Berlin.
A legally binding order can be placed by telephone, in writing (by post, fax or e-mail) or by clicking the button “Order with obligation to pay” in the online shop. When placing an order via the online shop, the Customer will receive an order confirmation by e-mail. This confirmation is generated automatically and does not state an acceptance of the order. A sales contract is only deemed concluded when the Publisher has successfully shipped the ordered product to the Customer or explicitly acknowledged a placed order. The Publisher further reserves the right to decline an order, e.g. after checking the Customer’s solvency.

  

§ 3 Revocation Right

Customers are entitled to the statutory right of revocation. A Customer is any natural person who, when concluding this agreement, is acting for purposes which are outside his trade, business or profession (§ 13 BGB, German Civil Code).

 

Revocation Policy

Right of Revocation
You may revoke the declared intention to conclude a contract within 14 days without stating the reasons. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the item(s).

To exercise the right of revocation, you must inform us (regiospectra Verlag, c/o Eva Streifeneder, Kolonnenstraße 8, 10827 Berlin, Phone: +49 (0)163 8050141, E-Mail: kontakt /at/ regiospectra.de) of the decision to withdraw from this contract by an unequivocal statement (e.g. a letter send by post or e-mail). You may use the provided revocation form, but it is not mandatory. You will find the revocation form here:

In order to meet the deadline for such revocation, it is sufficient to send the revocation notice before the period expires.

 

Consequences of Revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

 

End of Revocation Policy

 

The revocation right does not apply to items manufactured on special orders from the Customer or to items that were clearly customized to personal needs or that due to their properties cannot be shipped back.

Furthermore the revocation right does not apply to distance-selling contracts for the delivery of audio and video recordings or software if the delivered data medium has been unsealed by the Customer.

 

§ 4 Caveat of Unavailability

The Publisher reserves the right to withdraw from an order placed by the Customer if the ordered item is out of print or can temporarily not be delivered and hence is not available. In this case the Publisher will inform the Customer about the unavailability immediately and if necessary refund the already paid purchasing price.

In case of reprinted items, the new edition is delivered unless the Customer has explicitly objected the delivery of the reprinted item. If the customer has not explicitly objected, the right to compensation of received payments and benefits as specified in § 3 does not apply.

 

§ 5 Prices and Shipping Fees

All prices are in euro and include Value Added Tax (VAT). Because of the German Book Price Fixing Law the prices of the books determined by the Publisher are mandatory.

 

No shipping fees are charged for Customers in Germany.

For discounted orders placed by booksellers the postal charges for shipping with Deutsche Post are charged.

 

For orders  from outside of Germany the following shipping fees will be charged:

 

European Union (outside Germany)

1 exemplar: 4,00 euro

up to 3 exemplars: 10,00 euro

up to 5 exemplars: 14,50 euro

up to 10 exemplars: 20,00 euro

more than 10 exemplars: 35,00 euro

 

World (outside European Union)

1 exemplar: 6,00 euro

up to 3 exemplars: 14,00 euro

up to 5 exemplars: 25,00 euro

up to 10 exemplars: 45,00 euro

more than 10 exemplars: 85,00 euro

 

Custom duties and import taxes: For items delivered outside of Germany, customs duties or import taxes may be incurred in the country of destination. These charges are for the Customer's account. The Publisher has no influence on these costs.

 

§ 6 Return Charges

In case of revocation (§ 3) the Customer will have to bear the direct cost of returning the goods.

 

§ 7 Terms of Payment and Delivery

The standard delivery time is 3-5 days within Germany and about 1-3 weeks outside Germany after receiving the Customer's order. Unless otherwise agreed, the merchandise shall be delivered from stock to the address specified by the Customer. If the merchandise must be re-sent because of an incorrect or incomplete address, the Publisher will charge the shipping fees for the second shipment. If the merchandise cannot be delivered to the Customer because of a longer absence of the Customer, the Publisher will charge the shipping fees for the second shipment. The invoice is enclosed with the goods even if the shipping address differs. If the Customer explicitly wishes to send the invoice to a different address, an additional fee of 1 euro is charged. The invoiced amount is due within 14 days after receiving the items. Payments may be made by bank transfer or paypal. In case the Customer's payment becomes overdue, the Publisher is entitled to charge a penalty charge.

 

§ 8 Retention of Title

The goods delivered shall remain the Publisher’s property until the purchase price has been paid in full.

 

§ 9 Warranty

If the merchandise is damaged in any way the German legal warranty conditions are valid (§§ 434 ff. BGB).

 

§ 10 Applicable Law and Place of Jurisdiction

German law shall apply exclusively. Any application of CISG is hereby ruled out. If the Customer is a registered trader, a public corporation or a special trust managing public assets, Berlin shall be the place of jurisdiction for all legal disputes arising directly or indirectly from the contractual relationship between the Publisher and the Customer. In such event, Berlin shall be deemed to have been agreed as the place of jurisdiction.
